Good evening Mayor and city council. As the code is currently written it allows combining of multiple lots when one, or more meet the listed requirements. An example is if the a whole block of R-3 has one lot at the end that meets all the unique requirements then as many adjoining lots as desired can be combined together. Even if those other remaining lots are "normal" lots. I believe adding language such as: 10-2.514 (b) “Permitted lot combinations. Two (2) or more lots may be combined.." to "“Permitted lot combinations. Two (2) or more of the lots that meet all the requirements may be combined." This would only allow combination of the "defective" lots to make them useable but would not allow joining of lots if only one lot is unique as is the code now. Additionally consider changing 10-2.514 (b) (1) (c) to clarify what is "unusual" size. The Foundry Project showed that subjective "achieve an improved development more consistent with the character of development in the neighborhood" is difficult to clearly justify and open to too broad of an interpretation. Please consider revisions to improve the clarity and improve to maintain the intention of the code while making it more clear and more specific.
